US Judge Mandates Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.
In her decision, the judge noted that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
